Terms of Use

1. Eligibility & account

You must be at least 18 years old and able to form a binding contract to use the Service. You agree to provide accurate registration information, keep your password secure, and accept responsibility for all activity that occurs under your account. Notify us immediately at support@inspectrplus.app if you suspect unauthorized use.

2. License to use the App

Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to install and use the App on devices you own or control, solely for your internal business or personal use. You may not copy, modify, reverse-engineer, sublicense, lease, resell, or create derivative works of the App, except to the extent these restrictions are prohibited by law.

Apple-specific terms (iOS)

These Terms are between you and InspectrPlus, not with Apple. Apple is not responsible for the App or its content. To the maximum extent permitted by law, Apple has no warranty obligation with respect to the App. Apple is not responsible for addressing claims relating to the App, including product-liability claims, claims that the App fails to conform to legal or regulatory requirements, or claims arising under consumer protection or similar legislation. In the event of any third-party claim that the App or your use of it infringes that third party’s intellectual property rights, InspectrPlus, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of that claim. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

3. Subscriptions & auto-renewal

Refunds

Subscriptions purchased through the Apple App Store are subject to Apple’s refund policy — contact Apple Support. Subscriptions purchased through Google Play are subject to Google’s refund policy — contact Google Play Support. Subscriptions purchased directly from us are non-refundable except as required by applicable consumer-protection law.

4. Payments processed through Stripe

If you use InspectrPlus to invoice clients and collect payments, payment processing is provided by Stripe and is subject to the Stripe Connected Account Agreement, which includes the Stripe Services Agreement. By agreeing to these Terms or continuing to operate as a InspectrPlus payee, you agree to be bound by the Stripe Services Agreement, as it may be modified by Stripe from time to time. As a condition of InspectrPlus enabling payment processing through Stripe, you authorize InspectrPlus to obtain account data from Stripe and you agree to provide accurate and complete information about you and your business.

5. Your content

You retain ownership of content you upload to or create in the Service (“Your Content”), including inspection photos, notes, and reports. You grant us a worldwide, non-exclusive, royalty-free license to host, store, process, transmit, and display Your Content solely to provide and operate the Service for you. You represent that you have all rights needed to upload Your Content and that it does not violate any law or third-party right.

6. Acceptable use

You agree not to:

• Use the Service for any unlawful, harmful, fraudulent, or deceptive purpose.
• Upload content that infringes intellectual property, privacy, or other rights.
• Attempt to gain unauthorized access to any account, server, or system.
• Probe, scan, or test the vulnerability of the Service without our prior written consent.
• Use bots, scrapers, or other automated means to access the Service.
• Interfere with or disrupt the Service.
• Misrepresent yourself or impersonate any person or entity.

We may suspend or terminate accounts that violate these rules or that pose a risk to the Service or other users.

7. Third-party services

The Service relies on third parties including Apple, Google, Supabase, and Stripe. Your use of those services is governed by their own terms and privacy policies. We are not responsible for third-party services.

8. Intellectual property

The Service, including software, text, graphics, logos, and trademarks, is owned by or licensed to InspectrPlus and is protected by intellectual property laws. Except for the limited license granted in Section 2, no rights are granted to you in or to the Service.

9. Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including without limitation warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any defects will be corrected. Inspection reports generated through the Service are your professional work product; you are solely responsible for their accuracy and for compliance with applicable inspection standards, laws, and regulations.

10. Limitation of liability

To the maximum extent permitted by law, in no event will InspectrPlus or its officers, directors, employees, or agents be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, arising from your use of (or inability to use) the Service. Our total aggregate liability for any claim arising out of or relating to these Terms or the Service will not exceed the greater of (a) the amount you paid us in the twelve (12) months preceding the event giving rise to the liability, or (b) US $100.

11. Indemnification

You agree to indemnify, defend, and hold harmless InspectrPlus and its affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with: (a) your access to or use of the Service; (b) Your Content; (c) your violation of these Terms; or (d) your violation of any law or third-party right.

12. Termination

You may stop using the Service at any time and delete your account (see delete account). We may suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms or for any other reason. Sections that by their nature should survive termination (including ownership, disclaimers, limits of liability, and dispute resolution) will survive.

13. Governing law & disputes

These Terms are governed by the laws of the State of Washington, United States, without regard to its conflict-of-laws principles. The parties consent to the exclusive jurisdiction of the state and federal courts located in Spokane County, Washington for any dispute arising out of or relating to these Terms or the Service, except that either party may seek injunctive relief in any court of competent jurisdiction.

If you are a consumer located in the European Union, the United Kingdom, or another jurisdiction whose mandatory laws require otherwise, your local laws apply.

14. Changes to these Terms

We may update these Terms from time to time. If we make a material change, we will notify you through the App or by email and update the “Last updated” date above. Continued use of the Service after the change takes effect means you accept the updated Terms.
